Professional Liability Insurance
Professional liability insurance is provided by ERGO AG of 40198 Düsseldorf. The geographical scope of insurance coverage comprises operations in Germany, the Member States of the European Union and Turkey and satisfies the requirements of Section 67 of the Tax Consultancy Act (StBerG) and Section 51 et seq. of the Regulations on the Implementation of the Provisions for Tax Consultants, Tax Agents and Tax Consultancies (DVStB).
Alternative dispute resolution
In the event of disputes between tax consultants and their customers, upon request there is an opportunity for extrajudicial dispute resolution at the regional Chamber of Tax Consultants of Northern Baden. Upon application, the Chamber of Tax Consultants carries out a mediation process pursuant to Section 76(2)(3) of the Tax Consultancy Act (StBerG) in disputes between tax consultants and customers. The Chamber of Tax Consultants of Northern Baden can provide more detailed information on this.
Essential price information pursuant to Section 4 of the Regulations on Service Providers’ Duty to Provide Information (DL-InfoV)
If the tax consultant’s payment is established in advance, there shall be a specific written fee agreement. This written fee agreement may establish a price for an initial consultation, an all-inclusive price for services that are to be specified precisely in this agreement or billing for services using hourly rates to be agreed. In principle, the tax consultant’s fees are based on the Remuneration Regulations for Tax Consultants (StBVV). Starting from the relevant object values and taking account of the appropriate fee scales, this results in the relevant tax consultant’s fee plus the applicable value-added tax.
Since the calculation pursuant to the StBVV can usually only predict the final costs on a case by case basis and with a certain amount of effort, an individual estimation of the probable fees shall be made on the basis of the information supplied by the client before the order is accepted.
Pursuant to Section 11 of the Fee Regulations for Tax Consultants (StBGebV), the fees shall ultimately be decided taking account of all circumstances of the order to be completed, in particular the scope, difficulty and importance of the matter and the customer’s income and assets. In the case of work by a lawyer, a particular liability risk may also be allowed for in the calculation.
